5th Circuit Court Affirms Trump's Immigration Detention Without Bond

In a pivotal ruling, the 5th U.S. Circuit Court of Appeals has upheld theTrump administration's controversial policy allowing for the detention of immigrants without the option to post bond. This decision overturns a previous lower court ruling that had deemed this practice illegal.


The implications of this ruling extend primarily to the states of Louisiana, Mississippi, and Texas. Mo Goldman, a Tucson-based immigration attorney, pointed out that traditionally, immigrants who entered the U.S. unlawfully were able to secure their release on bond while waiting for deportation hearings. The new legal interpretation has drastically altered this established approach.


“This new view of the law that occurred last year has resulted in a huge increase in the number of people being detained,” noted Goldman, reflecting on the substantial shift in immigration detention practices.


Though the decision does not directly impact his clients located outside the 5th Circuit, Goldman expressed concern over possible repercussions. He stated, “I guess a bigger concern is whether they might start to try to move people into Texas and Louisiana, because ICE can pick up people and transfer them into other circuits,” highlighting the potential for wider effects on immigration policies.


The ruling emerged from a close 2-1 vote, with the majority endorsing the constitutionality of the no-bond policy. In contrast, dissenting judge Dana Douglas criticized the approach as both unprecedented and at odds with current immigration laws.
