Pentagon Probes Senator Mark Kelly Following Military Video Controversy
The Pentagon has initiated an investigation into Arizona Senator Mark Kelly, a retired Navy pilot, due to his recent involvement in a video that urges military personnel to disregard “illegal orders.” This development has prompted the Department of Defense to contemplate recalling retired service members for active duty, a rare step that may lead to potential court-martial proceedings involving a sitting member of Congress.
On Monday, a statement from the Pentagon referenced federal law that allows the defense secretary to summon retired military members back to duty, which can result in court-martial or other military actions. This announcement was made in the context of rising tensions following accusations of sedition from former President Donald Trump directed at lawmakers appearing in the video.
The controversial video features Senator Kelly alongside several other Democratic lawmakers with military or intelligence backgrounds, where they advocate for adherence to lawful orders. Kelly stated, “you can refuse illegal orders,” while his fellow lawmakers emphasized the importance of upholding the Constitution.
Defense Secretary Pete Hegseth pointed out that Kelly’s singular status as a fully retired military officer among the participants places him under Pentagon oversight. Hegseth criticized the messaging of the video, asserting on social media that “Kelly’s conduct brings discredit upon the armed forces and will be addressed appropriately,” further noting the potential risks posed by such statements which could create “doubt and confusion” within the ranks.
As of now, Senator Kelly has not publicly responded to the ongoing investigation. However, in a prior appearance on CBS’ “Face the Nation,” he expressed serious concerns regarding Trump's rhetoric and the implications it holds for national security.
Senator Ruben Gallego, a fellow Democrat from Arizona, came to Kelly's defense online, stating, “Mark told the truth — in America, we swear an oath to the Constitution, not wannabe kings.” This video surfaced amidst contentious military directives issued during the Trump administration, including orders regarding the destruction of small boats in the Caribbean and attempts to deploy National Guard members in U.S. cities.
Chief Pentagon spokesman Sean Parnell reaffirmed the military's duty to follow lawful directives from civilian authority, alongside the obligation of service members to refuse unlawful orders. This can present difficulties, particularly for lower-ranking personnel who rely on their superiors for clear guidance.
Despite the video’s intentions, reactions from the military community have been minimal. A former service member overseeing an online military forum observed that the video’s limited audience and its placement on X (formerly Twitter) might account for the subdued engagement, noting it was too lengthy for popular platforms like TikTok, where many service members usually receive updates.
