New Legislative Measures in Michigan to Strengthen Tenant Rights

The Michigan Legislature is advancing a significant set of bills known as the Tenant Empowerment Package, which aims to enhance the rights of tenants and improve living conditions in rental properties. This initiative comes as concerns mount regarding inadequate maintenance and unsafe housing across the state.

The Tenant Empowerment Package consists of four key pieces of legislation:

  • Senate Bill 19 and Senate Bill 20 enable tenants to withhold rent or make deductions for repair costs if landlords fail to make necessary safety repairs within a 48-hour period.

  • Senate Bill 21 requires landlords to provide a 90-day notice prior to any rent increases upon lease renewal.

  • Senate Bill 22 facilitates the electronic return of security deposits to ensure quicker access for tenants.

Advocates for the Tenant Empowerment Package stress that these regulations are vital not just for improving tenant rights, but also for rectifying Michigan's deteriorating housing quality. Remy Gelderloos, deputy chief of staff for state Senator Sarah Anthony (D-Lansing), noted that “This bill is really making sure that we are targeting and holding accountable those who are bad actors.”

Gelderloos highlighted the importance of the new 48-hour repair rule, stating, “This is critical to someone’s life and safety,” while acknowledging the complexities landlords face in addressing repairs efficiently.

Concerns over rental property conditions are prevalent, with many units in Lansing already “red-tagged” for safety violations. Gelderloos pointed out that similar issues are emerging throughout the state, indicating that the housing crisis is a widespread problem.

Additionally, the proposed legislation mandates that landlords address mold and pest infestations within a 72-hour window. Having successfully passed through committee, the Tenant Empowerment Package is now poised for a full Senate vote.
